Sexual Violence: Under Florida Statutes Section 784.046, a Sexual Violence injunction addresses cases of sexual assault, abuse, or rape. It provides victims with legal protections and necessary measures to ensure their safety and well-being in the face of sexual violence.  You may file a Sexual Violence restraining order if any one of the following has occurred:
i. Sexual battery
ii. A lewd or lascivious act, committed upon or in the presence of a person younger than 16
iii. Luring or enticing a child
iv. Sexual performance by a child
v. Any other forcible felony wherein a sexual act is committed or attempted

In addition, you must have reported the incident to law enforcement and be cooperating in any criminal proceedings or the Respondent must have been sentenced to prison and the term expired or is due to expire within 90 days.
