Repeat Violence: Under Florida Statutes Section 784.046, Repeat Violence injunctions are intended for individuals who have experienced two or more incidents of violence or stalking, one of which must have been within six months of the filing of the petition, committed by the same person or individuals acting in concert. Repeat Violence means any assault, battery, sexual battery, or stalking by a person against any other person.
The violence must be or have been directed against the petitioner or the petitioner’s immediate family member(s) that is a minor. All others must file their own petition. These injunctions aim to prevent future acts of violence and provide ongoing protection to victims.
